米国の雇用法
FLSA(Fair Labor Standard Act)
1938年連邦労働基準法
最低賃金と残業について規定した。
労働者をNon-ExemptかExemptに分けた。
(Non-Exceptの労働者には残業代を支払うがExemptの労働者には残業代は支払われない。)

下記はExemptの社員の最低給料に関する現行の規定で参考のために政府のウエブサイトから抜粋したものです。Non-Exempt(時給労働者)に関する規定はこの後、別に記載してあります。

Executive Exemption
To qualify for the executive employee exemption, all of the following tests must be met: • The employee must be compensated on a salary basis (as defined in the regulations) at a rate not less than $455 per week;
• The employee’s primary duty must be managing the enterprise, or managing a customarily recognized department or subdivision of the enterprise;
• The employee must customarily and regularly direct the work of at least two or more other full-time employees or their equivalent; and
• The employee must have the authority to hire or fire other employees, or the employee’s suggestions and recommendations as to the hiring, firing, advancement, promotion or any other change of status of other employees must be given particular weight.

Administrative Exemptions
To qualify for the administrative employee exemption, all of the following tests must be met: • The employee must be compensated on a salary or fee basis (as defined in the regulations) at a rate not less than $455 per week;
• The employee’s primary duty must be the performance of office or non-manual work directly related to the management or general business operations of the employer or the employer’s customers; and
• The employee’s primary duty includes the exercise of discretion and independent judgment with respect to matters of significance.
Professional Exemption

To qualify for the learned professional employee exemption, all of the following tests must be met:
• The employee must be compensated on a salary or fee basis (as defined in the regulations) at a rate not less than $455 per week;
• The employee’s primary duty must be the performance of work requiring advanced knowledge, defined as work which is predominantly intellectual in character and which includes work requiring the consistent exercise of discretion and judgment;
• The advanced knowledge must be in a field of science or learning; and
• The advanced knowledge must be customarily acquired by a prolonged course of specialized intellectual instruction.
To qualify for the creative professional employee exemption, all of the following tests must be met:
• The employee must be compensated on a salary or fee basis (as defined in the regulations) at a rate not less than $455 per week;
• The employee’s primary duty must be the performance of work requiring invention, imagination, originality or talent in a recognized field of artistic or creative endeavor.

Computer Employee Exemption
To qualify for the computer employee exemption, the following tests must be met: • The employee must be compensated either on a salary or fee basis (as defined in the regulations) at a rate not less than $455 per week or, if compensated on an hourly basis, at a rate not less than $27.63 an hour;
• The employee must be employed as a computer systems analyst, computer programmer, software engineer or other similarly skilled worker in the computer field performing the duties described below;
• The employee’s primary duty must consist of:
1) The application of systems analysis techniques and procedures, including consulting with users, to determine hardware, software or system functional specifications;
2) The design, development, documentation, analysis, creation, testing or modification of computer systems or programs, including prototypes, based on and related to user or system design specifications;
3) The design, documentation, testing, creation or modification of computer programs related to machine operating systems; or
4) A combination of the aforementioned duties, the performance of which requires the same level of skills.

Outside Sales Exemption
To qualify for the outside sales employee exemption, all of the following tests must be met: • The employee’s primary duty must be making sales (as defined in the FLSA), or obtaining orders or contracts for services or for the use of facilities for which a consideration will be paid by the client or customer; and
• The employee must be customarily and regularly engaged away from the employer’s place or places of business.

Highly Compensated Employees
Highly compensated employees performing office or non-manual work and paid total annual compensation of $100,000 or more (which must include at least $455 per week paid on a salary or fee basis) are exempt from the FLSA if they customarily and regularly perform at least one of the duties of an exempt executive, administrative or professional employee identified in the standard tests for exemption.

Blue Collar Workers
The exemptions provided by FLSA Section 13(a)(1) apply only to “white collar” employees who meet the salary and duties tests set forth in the Part 541 regulations. The exemptions do not apply to manual laborers or other “blue collar” workers who perform work involving repetitive operations with their hands, physical skill and energy. FLSA-covered, non-management employees in production, maintenance, construction and similar occupations such as carpenters, electricians, mechanics, plumbers, iron workers, craftsmen, operating engineers, longshoremen, construction workers and laborers are entitled to minimum wage and overtime premium pay under the FLSA, and are not exempt under the Part 541 regulations no matter how highly paid they might be.

Police, Fire Fighters, Paramedics & Other First Responders
The exemptions also do not apply to police officers, detectives, deputy sheriffs, state troopers, highway patrol officers, investigators, inspectors, correctional officers, parole or probation officers, park rangers, fire fighters, paramedics, emergency medical technicians, ambulance personnel, rescue workers, hazardous materials workers and similar employees, regardless of rank or pay level, who perform work such as preventing, controlling or extinguishing fires of any type; rescuing fire, crime or accident victims; preventing or detecting crimes; conducting investigations or inspections for violations of law; performing surveillance; pursuing, restraining and apprehending suspects; detaining or supervising suspected and convicted criminals, including those on probation or parole; interviewing witnesses; interrogating and fingerprinting suspects; preparing investigative reports; or other similar work.


Other Laws & Collective Bargaining Agreements
The FLSA provides minimum standards that may be exceeded, but cannot be waived or reduced. Employers must comply, for example, with any Federal, State or municipal laws, regulations or ordinances establishing a higher minimum wage or lower maximum workweek than those established under the FLSA. Similarly, employers may, on their own initiative or under a collective bargaining agreement, provide a higher wage, shorter workweek, or higher overtime premium than provided under the FLSA. While collective bargaining agreements cannot waive or reduce FLSA protections, nothing in the FLSA or the Part 541 regulation relieves employers from their contractual obligations under such bargaining agreements.

日系企業で留意しなければならない事はExemptとされた幹部社員が、倉庫等に入ってマニュアルな仕事をするとExemptの資格違反になる事です。

最新の最低賃金法は2016年5月18日最終規約の公表があり、施行は2016年12月1日からで、以下のように変更されます。

FLSA's minimum wage and overtime standards
Key Provisions of the Final Rule
The Final Rule focuses primarily on updating the salary and compensation levels needed for Executive, Administrative and Professional workers to be exempt. Specifically, the Final Rule:
1 Sets the standard salary level at the 40th percentile of earnings of full-time salaried workers in the lowest-wage Census Region, currently the South ($913 per week; $47,476 annually for a full-year worker);
2 Sets the total annual compensation requirement for highly compensated employees (HCE) subject to a minimal duties test to the annual equivalent of the 90th percentile of full-time salaried workers nationally ($134,004); and
3 Establishes a mechanism for automatically updating the salary and compensation levels every three years to maintain the levels at the above percentiles and to ensure that they continue to provide useful and effective tests for exemption. Additionally, the Final Rule amends the salary basis test to allow employers to use nondiscretionary bonuses and incentive payments (including commissions) to satisfy up to 10 percent of the new standard salary level.
The effective date of the final rule is December 1, 2016.

The initial increases to the standard salary level (from $455 to $913 per week) and HCE total annual compensation requirement (from $100,000 to $134,004 per year) will be effective on that date. Future automatic updates to those thresholds will occur every three years, beginning on January 1, 2020.

次回の値上げは2020年1月1日。労働省の概算 DOL estimates $984/wk($51,168/yr)
この新法により、カリフォルニア州では392,000人の給料が上がる予定。 全米を見ると、フロリダ、ニューヨーク、テキサス、カリフォルニアで この新法によって給料が上がる人が多い。

Overtime残業

連邦 1週間40時間以上働くと残業が適用。 通常時給の1.5倍
加州 1日8時間以上。 通常時給の1.5倍。1日12時間以上働くと2倍。

主な、主要な、大部分もしくは最重要の任務

EAPOH:

E: Executive (管理職)
A: Administrative (総務)昔の秘書、今でいうExective Assistantは、残業はもらえない立場

P: Professional (専門職)  法、医学、歯学、会計、建築、工学、教育。薬剤師はこのうちに入りません。

O: Outside sales (外回り営業) 50%以上の時間を外回りの人。物やサービスを販売していること。

H : Highly Compensated (高い報酬) 最低年間$100,000 →新法では$134,004

インディペンデント・マネジメント
日本の本社が決定することも多く、米国現地だけで判断ができない場合もあり、 難しい。

給料は固定。変更はできない。
ボーナスやコミッションは含まないとなっていましたが、新法ではその10%を含めても良いことになります。
それは契約に基づいたものであること。
そして、四半期ごとに支払われること。また、不足分は四半期後に支払われること。

サラリーに含まれないもの。

任意のボーナス、宿泊費用、医療、障害、生命保険、退職年金プランへの積立、その他費用。

日本では60歳、65歳の方が定年となりますが、同じ仕事を続けていくうえで、米国では年齢によって退職を促したり、給料はじめベネフィットを下げるなどは、違法。

下記はNon-Exempt社員に関する最低賃金の規定に関する情報です。参考のため、一部政府のウエブサイトからの抜粋も記載しました。

最低賃金 MINIMUM WAGE
現在連邦政府の最低賃金は $7.25 、一方、CAは時給$10
残業の計算も、連邦と州では違っています。
市の最低賃金もそれぞれ違い、ロサンゼルス市では$15/hr になるよう、デモなどが運動が行われています。

最低賃金のない州もあります。
アラバマ、ルイジアナ、ミシシッピ、サウスカロライナ、テネシー

ジョージアとワイオミングの最低賃金は$5.15

連邦政府の最低賃金を適用、フォローしているのは、米国50州のうち14州のみ。

カルフォルニアは世界で6番目に大きな経済。経済成長率は4.1%(全米は2.4%)

労働時間の定義
またリスクの定義
例えばホームオフィスでの労働時間を図るのは難しいのですが、最近はアプリなどもあります。

また制服がある飲食店では、従業員がその制服を着用する時間も労働時間に含まれるのでしょうか

連邦最高裁判所の判例 労働時間とはみなしません。

ただし、食品関連の業務で、マスクやエプロンなどを着用することは、会社だけではなく、社会のためですので、含まれます。
また倉庫勤務などでは、セキュリティーチェックがありますが、その時間も労働時間に含まれるのか? 答えはNO 
では、通勤時間は? 含まれません。 ただし、会社から営業先などへの移動は労働時間。
そして、出張時に空港で荷物をバゲージラインで待っていたり、チェックインすることは、労働時間に含まれます。


LAの最低賃金:(一週間に2時間以上働いた人はパートタイム、テンポラリー従業員に関わらず、最低賃金法が適用される。)

Employers with 26 or more employees shall pay a wage of no less than the hourly rates set forth:
1. On July 1, 2016, the hourly wage shall be $10.50.
2. On July 1, 2017, the hourly wage shall be $12.00.
3. On July 1, 2018, the hourly wage shall be $13.25.
4. On July 1, 2019, the hourly wage shall be $14.25.
5. On July 1, 2020, the hourly wage shall be $15.00.
Employers with 25 or fewer employees shall pay a wage of no less than the hourly rates set forth:
1. On July 1, 2017, the hourly wage shall be $10.50.
2. On July 1, 2018, the hourly wage shall be $12.00.
3. On July 1, 2019, the hourly wage shall be $13.25.
4. On July 1, 2020, the hourly wage shall be $14.25.
5. On July 1, 2021, the hourly wage shall be $15.00.


最低賃金違反(連邦)
*違反一件毎に$1,100の罰金

*幼年労働者違反。一人につき最高$11,000。
*幼年者に対し致死もしくは重傷に至る違反。一件につき$50,000。

記録保持:

賃金・労働時間に関する正確な記録保持は会社側の責務である。

記録保持の義務:

*従業員のフルネーム、ソシアルセキュリティー(最後4桁)
*郵便番号を含めた住所*19歳以下の場合は誕生日
*性別と職業(カルフォルニアは無し)
*その従業員の就業週の始まり
*毎日の就業時間
*毎週の就業時間数
*従業員給与からの源泉と追加の全て
*給与期間に支払われる賃金の合計
*支払いをカバーしている給与期間と支払日

タイムカード:

*Exempt以外の全ての従業員の記録を保持しなくてはならない
*就業開始時間と終了時間、食事休憩の記録必須
*3年間保存
